Аннотация
В статье исследуются разработка, общественное обсуждение и начальный этап реализации новой Конституции Республики Казахстан, принятой на республиканском референдуме 15 марта 2026 года. Цель исследования состоит в оценке процедурной легитимности конституционного обновления, содержания ключевых институциональных новелл и механизма их внедрения в законодательство и государственную практику. Эмпирическую основу составили материалы Конституционной комиссии, текст новой Конституции, официальные итоги референдума, Закон «О Курултае Республики Казахстан и статусе его депутатов», иные акты переходного периода, а также современные исследования по сравнительному конституционному праву. Использованы формально-юридический, системно-структурный, сравнительно-правовой и институциональный методы. Установлено, что реформа сочетает замену конституционного текста, перестройку архитектуры власти и нормативное закрепление обновленного ценностного порядка. Центральными изменениями являются переход от двухпалатного Парламента к однопалатному Курултаю, учреждение должности Вице-Президента, модификация законодательной и контрольной процедур, уточнение прав и обязанностей, а также создание особого переходного механизма. Сбор предложений через цифровые платформы и трансляция заседаний комиссии повысили открытость, однако качество участия требует мотивированной обратной связи о судьбе общественных инициатив. Обосновывается, что результативность реформы следует измерять не числом принятых актов, а независимостью институтов, судебной защищенностью прав и подотчетностью власти. Предлагаются поэтапная карта имплементации, публичный конституционный мониторинг и регулярная оценка правоприменения, позволяющие снизить риск декларативности новых норм. Результаты исследования предлагают прикладные ориентиры для законодателя, органов конституционного контроля и экспертов, оценивающих эффективность новой институциональной модели на переходном этапе.
